The law firm Morgan & Morgan has issued a warning to its attorneys following an incident where two lawyers cited fictitious court cases generated by an AI model. The email, sent to over 1,000 lawyers, highlighted the technology’s tendency to produce inaccurate information.
Rather than prohibiting AI usage, the firm emphasized the importance of verifying any cases identified through AI tools. The email stated, „if you use AI to identify cases for citation, every case must be independently verified.“ This caution comes after a federal judge in Wyoming reprimanded the two lawyers for referencing at least nine instances of fabricated case law in court filings.
During the court proceedings, the lawyers attributed the errors to an „internal AI tool“ and sought leniency from the judge. This incident raises concerns about the reliability of AI in legal contexts, especially as similar issues have been reported in at least seven cases over the past two years.
To mitigate future risks, Morgan & Morgan now requires attorneys to acknowledge their awareness of AI-related risks by confirming a checkbox in the firm’s AI tool. This measure aims to ensure that lawyers remain vigilant when utilizing AI for legal work.
